General Terms and Conditions (GTC) & Customer Information

1. Scope of Application and Provider
(1) These General Terms and Conditions apply to all contracts concluded between Simon Csaba e.v. (hereinafter referred to as “Service Provider” or “Seller”) and the Customer via the online shop rubberkiss.com (and connected platforms like Etsy, subject to their overriding terms of service).
(2) The services of the web store are available exclusively to persons over the age of 18.
(3) Diverging terms and conditions of the Customer shall not apply unless the Seller has expressly agreed to them in writing.

2. Products and Intellectual Property
(1) Handmade Nature: All our products are unique handmade items. Therefore, they may not exactly match the product images. Minor variations in color may occur due to manufacturing batches (e.g. from the latex manufacturer), for which we cannot accept responsibility.
(2) Authenticity: Products are only available via rubberkiss.com or rubberkiss.etsy.com. Products appearing on other sites with our images are considered counterfeit and are not covered by these GTC.
(3) Intellectual Property: All content on the website is the intellectual property of the Service Provider. Any reproduction or use without written permission is strictly prohibited.
3. Conclusion of Contract and Pricing
(1) The presentation of products does not constitute a legally binding offer. By placing an order, the Customer makes a binding offer to purchase.
(2) Pricing Errors: Orders based on manifest errors (e.g., obvious pricing mistakes like €0 or clearly unrealistic amounts) will not be processed as valid contracts. In such cases, we will contact the Customer to correct the error.
(3) VAT Status: Due to the Seller’s VAT exempt status under Hungarian law (Alanyi Adómentes), the invoice will show 0% VAT.
(4) Prices include packaging but exclude shipping costs.
4. Payment and Production Queue
(1) Accepted payment methods: Credit Card (Stripe), PayPal, Bank Transfer.
(2) Orders are placed in the production queue only after payment has been received and sizing parameters are clarified.
(3) Retention of Title: The goods remain the property of the Service Provider until full payment has been received.
5. Delivery and Shipping
(1) Production and Lead Times
a. Ready-to-Ship (In stock)
- General dispatch time: 1–3 working days.
b. Made-to-Order (Standard sizes) Production commences upon receipt of the order.
- Average production time: 4–6 weeks.
c. Made-to-Measure Adapting an existing model to the Customer’s individual measurements.
- Average production time: 6–8 weeks.
d. Bespoke (Custom Design) Designing and creating a completely new model.
- Total process: 12–16 weeks.
e. Rush Orders Purchasing a priority slot in the production queue for an additional fee. These options are only available for in-stock colors and material thicknesses.
- Guaranteed Priority: 10 working days (+30% surcharge).
- Express Production: 3–5 working days (+50% surcharge). The surcharge (+30% or +50%) applies to the total purchase price, including chosen options. Rush deadlines apply exclusively to the manufacturing process. If chlorination is requested, 1 additional week is added to the chosen rush deadline.
f. Modifying Factors (Additional Time)
- Chlorination: +1–2 weeks additional time.
- Peak seasons: Lead times are uniformly extended by 2 weeks during high-volume periods.
- Material shortages: If a specific color or thickness is out of stock, the lead time depends on our material procurement. Custom material orders are possible, subject to individual agreement and a surcharge.
- Missing information: In case of incomplete data or incorrect measurements, the order is placed “on hold” and removed from the production queue until the required information is fully provided.
(2) Shipping Methods: We ship via Magyar Posta, Foxpost, or Packeta. Items are sent in discreet, neutral packaging (padded envelopes or cardboard boxes for fragile items).
(3) Shipping Costs: Current shipping rates are displayed at checkout.
(4) Unclaimed Packages: If a package is returned to us because it was unclaimed, the cost of re-shipping shall be borne by the Customer. If the Customer does not pay the re-shipping cost within 30 days, the Service Provider reserves the right to dispose of the product without a refund, as customized items cannot be resold.
(5) Customs: For deliveries outside the EU, the Customer is responsible for any applicable customs and import duties.
6. Cancellation Policy (Right of Withdrawal)
(1) Exclusion of Right of Withdrawal: Pursuant to Section 29 of Government Decree 45/2014 (II. 26.) and relevant EU directives, the statutory right of withdrawal DOES NOT apply to our products because:
- They are custom-made to the consumer’s specifications (made-to-measure).
- They are sealed goods which cannot be returned for hygiene reasons (latex garments in direct contact with skin). Therefore, returns and refunds are generally excluded for delivered items.
(2) Cancellation Before Production: If the production has not yet commenced, the order can be cancelled free of charge, and the full purchase price will be refunded. Special Material Clause: If specific material was ordered for your custom item and the material order has already been placed by us, the cost of the material is non-refundable. In this case, we will ship the raw material to you.
(3) Cancellation After Production Starts: Once production has commenced, cancellation is no longer possible.
7. Warranty and Liability
(1) Statutory Warranty: Independent of the voluntary warranty detailed below, the Customer is entitled to statutory warranty rights under the Hungarian Civil Code (Ptk.) for a period of 2 years from delivery. The Customer may request repair or replacement, or—if these are not possible—a proportional price reduction, or withdraw from the contract in the case of a significant defect. Defective performance must be reported immediately upon discovery.
(2) Voluntary Lifetime Repair Warranty: We provide a voluntary, lifetime repair service for our latex garments under the following conditions:
- Definition of “Lifetime”: The reasonably expected lifespan of the latex material (typically 5–10 years with proper care).
- Scope: The warranty covers repairable damage resulting from normal intended use as well as accidental damage (e.g., accidental tears).
- Condition: The condition of the product must allow for repair (the material must not be aged, crumbling, or oxidized).
- Costs: Labor is free of charge. The Customer bears the cost of shipping (both ways) and the cost of any new materials required (e.g., replacement zippers, new panels).
- Exclusions: The warranty does not cover natural aging of latex, chemical damage (e.g., from improper care products, oils, metal contact), or modifications made by third parties.
(3) Sizing and Fit Disclaimer:
- Measurement Accuracy: We only guarantee the accuracy of measurements taken personally by us. We do not accept responsibility or liability for fit issues resulting from incorrect measurements provided by the Customer.
- Comfort vs. Fit: Please note that no garment can be 100% form-fitting and comfortable at the same time. To allow for movement, even the tightest latex garment must crease naturally. Complaints regarding natural wrinkling required for movement are not valid grounds for a warranty claim.
- Assessment of Complaints: To assess fit issues, we require visual proof (photo/video) of the garment being worn.
- Important: If the garment is not chlorinated, it must be worn with a generous amount of silicone lubricant to properly assess the fit, as friction can distort how the material sits on the body.
- Complaints based on measurements of the unworn garment (e.g., flat lay or talcum powder tests) are not valid methods of verification due to the nature of the material.
- Technological Constraints: Due to the inability to “fit-and-adjust” latex like traditional sewn fabric (where patterns can be altered during fitting), minor deviations inherent to the pattern-making process are not covered by warranty.
(4) Chlorination of Used Items:
- New Items: For new chlorinated products, minor surface variations are considered normal.
- Used Items: When performing after-market chlorination on used latex garments, the material’s history (absorbed body oils, silicone residue, prior exposure to metals, etc.) can cause unpredictable surface changes or discoloration. Since these reactions are unforeseeable, we cannot offer a warranty regarding aesthetic surface changes on used items submitted for chlorination. The Customer assumes all risks associated with such irregularities.
8. B2B / Corporate Customers
(1) For business partners, individual contracts apply regarding payment schedules and performance deadlines.
(2) In case of late payment, we reserve the right to charge default interest (Hungarian Central Bank Base Rate + 8%) and administrative costs.
9. Governing Law and Dispute Resolution
(1) The laws of Hungary shall apply. For consumer disputes, the mandatory statutory rules on jurisdiction apply. For business clients, exclusive jurisdiction lies with the Kaposvár District Court.
(2) Online Dispute Resolution (ODR): The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/.
